Options For Ending A Marriage

Our state allows for three different methods of ending a marriage: divorce, legal separation, and annulment. The most common path is divorce, which can either be done as a standard dissolution or a “summary dissolution”.

Summary dissolutions are a simpler version of the divorce process, a good option for couples who have been married less than five years, have little property and no children. Couples with children have to deal with issues of custody, and therefore must go through the standard divorce process.

In either case, no one has to cite anything specific the other spouse has done wrong. California is a “no fault” divorce state, meaning it is sufficient to simply file stating “irreconcilable differences”.

California Divides Community Property 50/50

California views all property and income acquired during a marriage as “community property” jointly owned by both spouses. Community property includes your income, debts, cars, home, bank accounts, 401(k) plans, stocks and essentially anything else of value. In divorce, all community property is split evenly between you and your former spouse, 50/50.

Courts assume that any property a married couple has is joint property. But, if you possess property you believe shouldn’t be divided equally between you and your spouse, you can challenge the community property assumption.
