California Custody Basics

It's important to keep in mind that child custody deals with two separate legal rights. Physical custody refers to where the child lives and, more importantly, which parent they live with. Legal custody is a parent's authority to make decisions about important parts of a child's life, such as health care, as well as where they go to school. One parent might have either one of these rights, or both. To decide questions of custody, a court focuses on what arrangement is in the best interest of the child.

Determining A Child's Best Interests

Neither parent is automatically given custody of children. California courts look to a variety of factors when deciding a custody plan that is in the child's best interests. Some of these factors are:

  • The child's age
  • Any health issues
  • Ties to school or community
  • Emotional connection to parent
  • Each parent's ability to care for the child, financially and emotionally
  • Family history of violence or drug abuse, if any

A parent's marital status, lifestyle, sexual orientation or religion is not a legitimate basis for rewarding or denying custody.
